BELLEVUE, Ohio -- Felony indecency charges against a Bellevue man accused of lewd behavior on a deck behind his house have been dismissed, the Toledo Blade reported.

Police said a neighbor in Bellevue videotaped Art Price <font color="red"> having sex </font> -- termed as "relations" -- <font color="red"> with his picnic table </font> on four separate occasions, WEWS-TV in Cleveland reported.

Price was charged with four counts of public indecency.

Oklahoma City Makes Top 10 'Hells On Earth'


Mayor Says Ranking Slam Over NBA Team Relocation Effort

OKLAHOMA CITY -- What does Oklahoma City have in common with the likes of Chernobyl and Baghdad? They're all "Hells on Earth," according to AskMen.com.

Oklahoma City was the only American city to make the Web site's list, at No. 5, more hellish than cities like No. 10 Baghdad, Iraq; and No. 6 Chernobyl, Ukraine; but less hellish than No. 4 Pyongyang, North Korea; and No. 1 Port Moresby, Papua New Guinea.

While Oklahoma City Mayor Mick Cornett said the city's ranking on the list could be somebody's slam over the relocation situation regarding the Seattle Supersonics, the creator of the list said that couldn't be further from the truth, reported KOCO-TV in Oklahoma City.

Nick Clarke said from Marbella, Spain, that his travel feature was merely about Oklahoma City's wide variety of severe weather.

"I visited (Oklahoma City) a few years ago. It's nice. Not one of my favorite places, but I enjoyed my time," he said.

Of Oklahoma City, Clarke wrote:
"While it may be all hunky-dory on the musical front, Oklahoma City isn't the kind of place you'd want to hang out in for too long if you like to keep your feet on terra firma. The weather is frighteningly unpredictable, with blizzards often descending on the city and winds that could knock a high rise clean off its feet. It is, after all, located in the direct path of 'Tornado Alley.'

The worst time to visit would be from March to August, when The Day After Tomorrow-style weather is pretty much expected. In fact, the severe weather season makes Dorothy's Kansas look positively calm, with Oklahoma City being the city worst affected by tornadoes in the United States. One of the most powerful tornadoes on record -- an F5 with wind speeds of 320 mph -- devastated much of the city in 1999, securing its place on our list of hells on earth."

Of the feature's most hellish place on Earth, Clarke wrote:
"With over 115 new HIV and AIDS cases diagnosed every month at Port Moresby General Hospital, the capital of Papua New Guinea isn't at the top of this list for much except being the 'worst place to live in the world,' according to a 2004 vote by the Economist's Intelligence Unit. With the population expanding at an uncontrollable rate, employment levels have rocketed, income levels have plummeted and cases of rape, robbery and murder have reached new heights (the murder rate is 23 times that of London).

Gang members, known as 'raskols,' have been known to carry out bank robberies with M16 machine guns, hijack cars wielding machetes and, in one case, drag an injured nurse from a car wreck to rape her. Clearly, the 'rascal' tag does them a disservice. If you don't have time to pick up some souvenirs, don't worry; you'll almost certainly have picked up a disease or two to take home with you."

"It's one person's, one company's opinion. You have to take everything with a pinch of salt," the British-born Clarke said. "It's not a knock on the people, crime or possible pollution in Oklahoma. It was strictly about the weather."

Clarke, 23, is a freelance writer specializing in pop culture and travel. He said the list was a collaboration between him and the AskMen.com staff. The "Hells on Earth" feature was aggregated to an online Web site from AOL Travel; however, AOL has since removed Oklahoma City from its list.

However, Cornett told KOCO-TV that he's not convinced. He said he believes Oklahoma City's inclusion in the list was generated by somebody who has a grudge over the Sonics' relocation to Oklahoma City.

Cornett said he would watch to see how the story progresses.

KOCO-TV contacted James Bassil, AskMen.com's editor-in-chief, and he stressed that the site's "Hells on Earth" feature was meant to be humorous.

"AskMen.com included Oklahoma City on a tongue-in-cheek list of travel destinations because of the constant weather challenges that the city faces. This list was written in a lighthearted, humorous tone and was not meant to disparage Oklahoma City as a place to live, work or raise a family," Bassil said.

The other cities making the list were No. 9 Dhaka, Bangladesh; No. 8 Yakutsk, Russia; No. 7 Mogadishu, Somalia; No. 3 Bujumbura, Republic of Burundi; and No. 2 Linfen, China.

WASHINGTON -- Marijuana potency increased last year to the highest level in more than 30 years, posing greater health risks to people who may view the drug as harmless, according to a report released Thursday by the White House.

The latest analysis from the University of Mississippi's Potency Monitoring Project tracked the average amount of THC, the psychoactive ingredient in marijuana, in samples seized by law enforcement agencies from 1975 through 2007.

It found that the average amount of THC reached 9.6 percent in 2007, compared with 8.75 percent the previous year.

The 9.6 percent level represents more than a doubling of marijuana potency since 1983, when it averaged just under 4 percent.

"Today's report makes it more important than ever that we get past outdated, anachronistic views of marijuana," said John Walters, director of the White House Office of National Drug Control Policy. He cited baby boomer parents who might have misguided notions that the drug contains the weaker potency levels of the 1970s.

"Marijuana potency has grown steeply over the past decade, with serious implications in particular for young people," Walters said. He cited the risk of psychological, cognitive and respiratory problems, and the potential for users to become dependent on drugs such as cocaine and heroin.

While the drug's potency may be rising, marijuana users generally adjust to the level of potency and smoke it accordingly, said Dr. Mitch Earleywine, who teaches psychology at the State University of New York in Albany and serves as an adviser for marijuana advocacy groups.

"Stronger cannabis leads to less inhaled smoke," he said.

The White House office attributed the increases in marijuana potency to sophisticated growing techniques that drug traffickers are using at sites in the United States and Canada.

A report from the office last month found that a teenager who has been depressed in the past year was more than twice as likely to have used marijuana than teenagers who have not reported being depressed -- 25 percent compared with 12 percent.

The study said marijuana use increased the risk of developing mental disorders by 40 percent.

"The increases in marijuana potency are of concern since they increase the likelihood of acute toxicity, including mental impairment," said Dr. Nora Volkow, director of the National Institute on Drug Abuse, which funded the University of Mississippi study.

"Particularly worrisome is the possibility that the more potent THC might be more effective at triggering the changes in the brain that can lead to addiction," Volkow said.

But there's no data showing that a higher potency in marijuana leads to more addiction, Earleywine said, and marijuana's withdrawal symptoms are mild at best. "Mild irritability, craving for marijuana and decreased appetite -- I mean those are laughable when you talk about withdrawal from a drug. Caffeine is worse."

The project analyzed data on 62,797 cannabis samples, 1,302 hashish samples, and 468 hash oil samples obtained primarily from seizures by law enforcement agencies in 48 states since 1975.

LOS ANGELES -- A California woman has filed a lawsuit against Victoria's Secret, alleging that she was injured while putting on her thong, KNBC-TV in Los Angeles reported.

Marcrida Patterson, 52, said she was injured by a defective "low-rise v-string" made by Victoria's Secret. The item is part of the company's "Sexy Little Thing" line.

Patterson claimed she was putting on the thong when a decorative metal piece flew off and struck her in the eye. She suffered permanent damage to her cornea, according to the lawsuit.

A copy of the June 9 complaint was posted on the Web site TheSmokingGun.com. The site reported that the lawsuit does not specify monetary damages.

Patterson's lawyer said a "design problem" caused the piece to fly off and strike Patterson, according to the Web site.

The Web site reported that a Victoria's Secret representative requested to examine the thong before the lawsuit was filed. The request was rejected by Patterson's attorney, according to the site.

When I first saw her I read SCAM all over her face. It's like the Mickey D's coffee incident from a bit back... take some responsibility for your own actions. No one at Victoria Secret is directly responsible for your freak accident. I feel awful if she truly does have permananet eye damage. I had a hyphema and busted orbital that rendered me blind in one eye for two days. Was basically laid out for 10. It was the scariest thing I've ever been through. For some reason, I dont see that here. Guess we'll find out how legit she really is when they go to court.

FYI.... Too small a piece on too wide a frame is bound to snap like a stale pretzel... pieces here and there. Just word to the unwise. ;)

I agree with you that people need to take responsibility, but the incident with McDonald's coffee is a little bit more than one person being burned. Man climbing tree to retrieve Frisbee dies after falling 30 feet

An autopsy was conducted today on a Santa Rosa man who apparently fell to his death while attempting to retrieve a Frisbee from a tree at Howarth Park Saturday evening.

The results of the autopsy on 23-year-old Robert Wood are being withheld pending toxicology tests, the Sonoma County coroner's office reported.

The fire department responded to the park at 6:11 p.m. Saturday and found Wood face down on the ground between two redwood trees, Santa Rosa Fire Department Battalion Chief Andy Pforsich said.

Paramedics tried unsuccessfully to revive Wood. He was pronounced dead at the scene, Pforsich said.

A caller to the fire department said Wood was about 30 feet up in the tree when he fell, Pforsich said.

Frisbee golf gaining fans

With Tiger Woods winning tournaments in heroic fashion in recent years, golf has seen a lot more attention than normal.

But while many potential newcomers want to pursue their golf dreams, money stays tight and courses shut their doors to the public.

Those are just two of the reasons that disc golf, or frisbee golf, has been up-and-coming � coupled with the local efforts of Jeff "Uhle" Uhlenberg.

<font color="red"> Uhlenberg has become one of the most recognizable figures in disc golf and ultimate Frisbee in the Philadelphia area. </font>

And it seems that all he wants out of it is a smile on his face.

"It�s more fun that you can imagine," he said. "Everyone started somewhere with that first throw, and if you go to an established course, there will be someone who will help you. (Disc golfers) are positive and highly spirited people.

"It�s a lot like life. You get frustrated, but you work on it and improve."

The rules of disc golf nearly mirror those of the golf our grandfathers played, but there are a few variations. Some depend on who is playing.

"Just like regular golf, there are par-3s, 4s and 5s," Uhlenberg said. "The most common number is par-3, but some courses have different teas and some tees are placed to be more challenging. There are also mandatories where you have to go around something to a specific side."

For beginners, heading out to a disc golf course with a typical ultimate-style Frisbee would be just fine. But for anyone who wants to take their game to the next level, Uhlenberg suggests buying a disc golf set.

Still, disc golf is much more affordable than its traditional counterpart. Golf clubs can easily run $200-2,000, while each outing could average $50 coming out of a player�s pocket.

"It�s the most fun you can have for the least amount of money," Uhlenberg says of disc golf. "You can go out and buy a set of three or four discs (which generally consists of a driver, mid-range disc and putter) for about 25 or 30 bucks, and those should last many years."

As for the price of a day on the course, most of the time it�s free of charge.

"Most courses are in public parks that are free," said Uhlenberg. "I�ve played on pay-to-play courses that are only about $3-5 to play. I�ve heard of $8-10, but that�s the most I�ve ever heard."

Other than soccer � futbol to anyone north, south, east or west of the U.S. � traditional golf is the closest thing to a truly global sport.

But what many people don�t know, is that disc golf has followed closely behind.

"It is truly an international sport, just about every continent including Antarctica has it," said Uhlenberg. "I played in Hawaii one time. I was driving along, saw the baskets and I just said, �Let�s go play some disc golf.�

If you find yourself saying the same thing after reading this article, and want to head out for a round of anywhere from nine to 27 holes, the best bets are Landis Park in Vineland or Sedgley Woods in Fairmount Park, Philadelphia.

"You can play nine holes at Sedgley in 30 minutes," Uhlenberg said. "The return in the investment is priceless. I know people who were iffy, and when they try it they think it�s unbelievable."

When I lived in Salt Lake City these Mormons came to the house and did their speech. After we told them no thanks they always ask, "Is there anything we can do for you?" So my roommate, who is the last person they would want to join their religion, told them to get the dogs frisbee out of the tree. So the two elders, in shirt and ties, climbed the tree and got it down for us.

Another time we hired one to drive us around to all the bars in town so none of us would have to drive. It was priceless!!!

SAN LUIS OBISPO, Calif. (AP) _ Two practical jokers are behind bars for setting their passed-out drinking buddy's crotch ablaze while boozing in Grover Beach. Matthew Craig Pillers and Jack Brent Nicholas Keiffer pleaded no contest to a felony great bodily injury charge.

Prosecutors say the 22-year-old Pillers, a parolee, was sentenced to two years in prison and the 19-year-old Keiffer got 45 days in San Luis Obispo County jail.

Elliot Tuleja was passed out when the men poured cologne on the man's groin and set him on fire on Jan. 18. Tuleja had second-degree burns on his testicles.

MONROE, Wash. - Police say a trail of pillows and backpacks led to two sleeping men who were arrested after a department store break-in.

Twenty-five-year-old Kyle Burress and 27-year-old Allen Pierce have been charged with second-degree burglary.

Police spokeswoman Debbie Willis says a break-in was discovered July 9 at a Fred Meyer department store northeast of Seattle. The two were still being held on bail Monday, and it was not clear whether they had lawyers.

Willis says police followed a trail of cardboard and items from storage containers in a locked area behind the store that led to the two men. One was sleeping in a stolen hammock and the other on a pile of stolen pillows.

Police photographed the men before waking and arresting them.

Willis says alcohol was involved.

PROVIDENCE, R.I. (AP) � State Police arrested a man early Tuesday whose blood alcohol level allegedly was .491 � more than six times the legal limit � which they believe is the highest ever recorded in Rhode Island for someone who wasn't dead.

Stanley Kobierowski, 34, of North Providence, was arrested after he drove into a highway message board on Interstate 95 in Providence, Maj. Steven O'Donnell said.

After police arrived, Kobierowski had trouble getting out of the car, then grabbed it and refused to move, forcing troopers to carry him to the breakdown lane before taking him back to their barracks, O'Donnell said.

A Breathalyzer test showed Kobierowski had blood alcohol readings of .489 followed by .491, O'Donnell said, the highest readings anyone at the State Police or the Department of Health could remember for someone who didn't end up dead.

The legal limit in Rhode Island is .08. A blood alcohol of .3 is classified as "stupor," .4 is "comatose" and .5 is considered fatal, according to the health department.

"Our only assumption could be that the person has a serious alcohol problem," O'Donnell said. "The person's lucky they survived. There's no doubt he would have gotten killed or killed someone if he had continued on the route he was taking."

Kobierowski was taken to Rhode Island Hospital where he was put in the detoxification unit and sedated, O'Donnell said. He was arraigned Tuesday afternoon on charges of driving while intoxicated and resisting arrest.

He was released after promising to appear at hearing Friday in district court.

Kobierowski did not have an attorney at his arraignment, police said. A phone listing for him could not be found.

Woman stabs herself during Wiccan ceremony
Accident happens during good-luck ritual

LEBANON, Ind. - A woman accidentally stabbed herself in the foot with a 3-foot-long sword while performing a Wiccan good luck ritual at a cemetery in central Indiana.

Katherine Gunther, 36, of Lebanon, pierced her left foot with the sword while performing the rite at Oak Hill Cemetery, police said.

Gunther said she was performing the ceremony to give thanks for a recent run of good luck. The ceremony involves the use of candles, incense and driving swords into the ground during the full moon.

Gunther said was aiming to put the sword in the ground, but hit her foot instead.

"It wasn't the first time I performed the ritual, but it was the first time I put a sword through my foot," she said.

Gunther immediately pulled the sword out of her foot, and her companions took her to Witham Memorial Hospital, where she was kept a couple days for treatment.

No charges were filed, police said. The Wiccans were warned that being in the cemetery in the city about 20 miles northwest of Indianapolis after posted visiting hours constitutes trespassing.

Wicca is a nature-based religion based on respect for the earth, nature and the cycle of the seasons.

This is hilarious, my college intramural flag football team used this formation! We had one great thrower, who couldn't run, and one great runner, who couldn't throw. You kept the other team on their toes because they never knew who was going to get the ball. We ran a couple of awesome misdirections and every time the two ran past each other the other team would hesitate expecting a hand off. We also threw stunts on the line where we'd open a hole let the offensive linemen come while stunting a smaller hole that we'd go through.

Now, Tony knows me, I was a defensive lineman on this team. We did this cause we were small, very small. It worked. We got all the way to the championships before we met a behemoth that was big and fast. They didn't try and stop us, they just hit any one who had the ball or had at one time had the ball, hard. We limped off the field. We still almost beat them, 14 to 7 and we led until the last quarter when the bruises and injuries caught up with us.

The message though is this can work if you run it right.

I fail to see the problem here? I have a few lawnmowers I'd like to shoot myself... I do remember fondly, my uncle's father kicking a lawnmower to pieces when it wouldn't start.

None of that tops the woman who decided at 3:00 a.m. that she was tired of the wart on her toe and was going to remove it with a shotgun. My friend who saw her at 4:00 a.m. in the Ben Taub E.R. said he'd never been completely speechless before in his entire life.

I also don't see why it is illegal for him to have a modified shotgun.

What an excellent article! Too sweet. All of the global warming nay-sayers should read this, especially the last few sections were he writes about what makes a credible source and why some people are doubters. I especially liked the parts about paranoia and a need to prove they are intellectually superior because they find "faults." The most telling part (and this extends to the GW crowd) is the tactic of only presenting the data they think supports their position, instead of looking at all the data.

NEW YORK (AP)�Former NBA referee Tim Donaghy was sentenced to 15 months in prison Tuesday for setting off a gambling scandal that tarnished the league�s reputation and raised questions about the integrity of its officiating.

The sentencing in Brooklyn federal court culminated a case that hung over the league throughout the season and even into the NBA finals between the Boston Celtics and Los Angeles Lakers. League commissioner David Stern has repeatedly denied Donaghy�s claim that corruption among referees goes beyond him.

Donaghy�s lawyer had asked the judge for probation. Donaghy had faced up to 33 months in prison, but the judge gave him credit for his cooperation.

Folding his arms but showing no other emotion, the 41-year-old Donaghy apologized to the court. �I brought shame on myself and my family,� he said.

Donaghy pleaded guilty last August to conspiracy to engage in wire fraud and transmitting betting information through interstate commerce for taking payoffs from a professional gambler for inside tips on games.

�By having this nonpublic information, I was in a unique position to predict the outcome of NBA games,� he told a judge at the time.

Donaghy didn�t stop there: In June, he marred the NBA finals by making fresh accusations that the league routinely encouraged refs to ring up bogus fouls to manipulate results but discouraged them from calling technical fouls on star players to keep them in games and protect ticket sales and television ratings.

The allegations�contained in court papers arguing that Donaghy deserved leniency for voluntarily disclosing the alleged corruption�included one instance claiming referees rigged a 2002 playoff series to force it to a revenue-boosting seventh game.

Though the papers didn�t name the teams involved, only the Los Angeles Lakers-Sacramento Kings series went to seven games during those playoffs. The Lakers went on to win the championship.

Both Stern and the league�s officials have said Donaghy made the claims to get a lighter sentence.

�We anticipate that the judge�s sentencing decision, together with the changes we have made to our referee operations staff, will enable us to continue with the improvements we are making to our anti-gambling rules, policies and procedures,� Stern said Tuesday.

�There is little comfort to be gained from the mandatory prison sentence, especially as it affects Mr. Donaghy�s children and their mother, but hopefully the healing process can begin in earnest for all.�

The NBA has made a number of changes to its officiating program in the wake of the scandal. Former Army Gen. Ron Johnson was hired as senior vice president of referee operations, Bernie Fryer and Joe Borgia were promoted to new management positions and the league reassigned Ronnie Nunn, who had been the director of officials for five years.

Last week, two of Donaghy�s former high school classmates were sentenced to over a year in prison for their roles in the scheme.

James Battista, a professional gambler and admitted drug addict, got 15 months in prison for making bets based on inside tips. Thomas Martino, the scheme�s middleman, was sentenced to a year and one day for paying the referee thousands of dollars for the tips. The three men attended school together in Springfield, Pa.

The league had demanded nearly $1.4 million in restitution. But the judge last week set the restitution at $217,266, to be paid jointly by the three defendants.

�Though we believe no sentence would ever be able to repair or justify the damage caused by this criminal and scoundrel, we are glad to finally put this behind us,� said Lamell McMorris, spokesperson for the National Basketball Referees Association.

�Tim acted in a completely selfish and unforgivable way, and has forever compromised the way people look at sports and officiating. However, NBA referees will continue to officiate with the highest level of integrity and professionalism.�

That's part of the reason I'm a gun control advocate, i.e. guns + alcohol. If only smart people had guns I'd have no problem. I grew up hunting, know 5 people who've been shot by idiots and have seen three more shot. In all the cases where I knew the person it was either done with an "unloaded" gun or a "I know I saw a deer" incident. The other three cases were two bodies I saw while living in NY, and the last was classic. I was dove hunting with my dad and uncles when I was 12 and this dumb donkey was shooting up over a rise. Unfortunately, on the far side of that rise was a county road. The dink peppered a county cop car, and then peppered the country cop when he got out to see what was going on. I've never seen a cop so mad before! Have to say though, this guy almost made Cheney look smart.

Too many dumb people have guns.

A few years ago Michigan adopted a "shall issue" concealed carrying permit. It used to be in the gun board's discretion who got a concealed weapons permit and that meant only their buddies got one. Now they have to issue one to anyone who applies unless the applicant has a felony or mental health history.

I work in the courts. I have not seen any gun crimes being committed by people who are lawfully carrying a concealed weapon. Ever. Most people get the concealed carry permit just to cover over the grey areas when they are transporting their guns to go hunting or go to the range.

Your Email: Alexandria (web|news) - A 911 tape, reportedly of Sen. John McCain (web|news|bio) 's brother Joe, could prove controversial for the McCain camp since the call was not for an emergency, but rather to complain about being stuck in traffic.

The call came into Alexandria's 911 system on October 21.

Operator: 911 state your emergency

Caller: It's not an emergency, but do you know why on one side at the **** drawbridge of 95 traffic is stopped for 15 minutes and yet traffic's coming the other way?

Operator: Sir, are you calling 911 to complain about traffic? (pause)

Caller: "(Expletive) you." (caller hangs up)

The complaint call about traffic on the Wilson Bridge forced the 911 dispatcher to call back. The voice mail on the other end, appears to belong to Joe McCain, brother of presidential candidate, John McCain.

"Hi this is Joe McCain. I can't take this message now because I'm involved in a very (inaudible) important political project. I hope on November 4th we have elected John."

"I think it's horrible. I can't believe somebody would tie up valuable resources to complain about traffic," said District resident Nancy Case.

"It seems stupid, my name can be tagged to this, why would I hose my brother, why would I do it," asked District resident Rob Case.

But that wasn't all. McCain apparently called 911 again to complain about the message the operator just left him, warning him such use of 911 is criminal.

Caller: Somebody gave me this riot act about the violation of police.

Operator: Did you just call 911 in reference to this?

Caller: Yeah.

Operator: 911 is to be used for emergencies only not just because you're sitting in traffic.

"The future president, possible president whatever, possible president, can't control what someone does, but this gentleman should be fined or something should happen to him," said tourist Suzanna Rey.

The McCain campaign has not commented on the issue, although it's said the campaign did listen to the call. ABC 7/NewsChannel 8 crews tried to reach Joe McCain, but were unable to

A Pittsburgh police commander told KDKA Investigator Marty Griffin that Ashley Todd confessed to making up the story &amp; is facing charges
PITTSBURGH (KDKA) &amp;#8213; Police tell KDKA that a campaign volunteer has now confessed to making up a story that a mugger attacked her and cut the letter B in her face after seeing her McCain bumper sticker.

Ashley Todd, 20, of Texas, initially told police that she was robbed at an ATM in Bloomfield and that the suspect became enraged and started beating her after seeing her GOP sticker on her car.

Police investigating the alleged attack, however, began to notice some inconsistencies in her story and administered a polygraph test.

Authorities, however, declined to release the results of that test.

Investigators did say that they received photos from the ATM machine and "the photographs were verified as not being the victim making the transaction."

This afternoon, a Pittsburgh police commander told KDKA Investigator Marty Griffin that Todd confessed to making up the story.

The commander added that Todd will face charges; but police have not commented on what those charges will be.

Authorities are expected to release more details at a news conference this afternoon.

According to police, investigators working on the interview process detected several inconsistencies in Todd's story that differed from statements made in the original police report.

Pittsburgh Police Public Information Officer Diane Richard released a statement earlier today, saying: "Because of the inconsistencies in her statements, Ms. Todd was asked to submit to a polygraph examination which she agreed to do."

No photos of Todd are being released by Pittsburgh Police at this time

I have read several articles on this, no one seems to know why the government stole the parents.

Until we are given a reason, I will not comment other than to say that except in the case of molestation or physical abuse, I don't see a reason to take a child away from there kids.

Sorry, but if they took the kids because of there names, that is just flat our wrong.


Edit - It appears that the Family has not made any comment and the government has stated that they do not take kids away because of a name. However no one has stated by the kids were stolen from the parents.

Actually, it turns out, as I understand it, that the FBI developed these tools to spy, on terrorists... The notion was that they could follow the terrorists around, listen in on their conversations even when their phones were "off," and keep us safe. Za is correct, it's pretty darn scary stuff. You don't load the software on your phone, it gets done for you, like a virus so to speak.

a. Ardito's Cellular Telephone

Based on physical surveillance and the conversations previously
intercepted, the FBI learned that Ardito's crew no longer conducted
meetings exclusively at the four restaurants, but met also in twelve
additional restaurants, automobiles, Ardito's home, an auto store, an
insurance office, a jewelry store, a doctor's office, a boat, and
public streets.

The government applied for a "roving bug," that is, the interception
of Ardito's conversations at locations that were "not practical" to
specify, as authorized by 18 U.S.C. § 2518(11)(a). Judge Jones
granted the application, authorizing continued interception at the
four restaurants and the installation of a listening device in
Ardito's cellular telephone. The device functioned whether the phone
was powered on or off, intercepting conversations within its range

attorney and close associate of Ardito, was relaying messages to and

government sought, and Judge Jones in due course granted, authority to
install a roving bug in Peluso's cellular telephone. This order was
renewed several times throughout 2004, as the government continued to
identify locations where Peluso and Ardito discussed family matters
and learned that the subjects were growing increasingly cautious of
government surveillance.

n January 2005, Peluso agreed to cooperate with the government's
investigation. At that point the government removed the listening
device in his cellular telephone and Peluso began recording
conversations with family members consensually by wearing a
microphone. On July 7, 2005, Peluso pleaded guilty, pursuant to a
cooperation agreement with the government, to a four-count
information, charging him with, among other things, engaging in a
pattern of racketeering activity."

the fact still remains, someone the FBI did in fact put the spywear in those phones. I am more worried about the fact it can happen than how it actually does happen.

Sorry Brian, but Kurt is winning this one. I've heard the argument that there is an app that the FBI can download into any phone for their convenience, but I'm not seeing the evidence. If there is one thing I know for sure, if there's no evidence, it's not likely to be true. Things like this are hard to keep secret, even if the major news outlets ignore them.
